• To reserve the Session Date and to reserve Images by Iya, Client shall pay to the Photographer, upon execution of this Agreement, a non-refundable deposit of $50. Client understands and agrees that Photographer will not book other sessions during this time.The deposit  fee will be deducted from the cost of the client's chosen package when calculating the final balance due. In the event that Client cancels the portrait session or fails to attend the session on the Session Date, for any reason understands that the deposit fee is NON-REFUNDABLE. 

• You may choose to reschedule your session at any time up until 7 days prior to your scheduled session. Your session may only be rescheduled twice in the same calendar year without having to pay a new deposit.

• In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid. 

       The photographer will endeavor to put the client(s) in touch with another photographer in the event they are unable to attend scheduled shoot due to any             cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc. 

 

•  A $25 late fee will be assessed if you are between 15-25 minutes late. If you are more than 30 minutes late, the session will be cancelled and is non refundable and non transferable. The session clock will start at the agreed upon time, and additional time will not be added to a session in the event of tardiness due to respecting the next client time.

• Photographer will deliver proofs of photos to client no later then 24-48 hours after the date of the shoot. 

• All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. The Photographer shall make gallery proofs available through an online gallery proofing website. These proofs shall be available to the Client within 24-48 hours after completed session. Online proofing gallery shall remain open for 30 days from delivery of edits before being discarded. 

• All sessions include a set amount of edited/retouched images. In the event that you'd like to have even more pictures retouched, awesome! Additional retouching is $10 per image and is billed with a new invoice & requires additional time.

                                  Any material that has not been paid for or purchased is considered the sole property of Images By Iya.

Copyright and Reproductions. The US Copyright Act protects professional photographers by granting them the exclusive rights to all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the Photographer. Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind. Please understand that I take my service to you as a professional very seriously, and you have hired me for our quality, artistry, expertise and reputation. In order to protect my reputation and quality of work for my clients, I must maintain complete control over the printing and quality of the presentation of the images, as well as all forms of reproduction of these images.

Strictly no refunds unless photographer is at fault. Willing to reshoot or re-edit within 7 days of receipt of images., all complaints should first be raised by the Client with the Photographer in writing within 7 days from the date of receipt of un-dowloaded images.
